• be an individual, corporate entity, legal person, entity or other organization with full autonomy, capacity to (1) access and use Fuelbtc services; and (2) enter into and comply with obligations under these terms and services.

2.2. Account Security and Confidentiality

Keeping your account safe and confidential is crucial. We’ll provide you with some tips and tricks to protect your account, but we can’t be responsible if you use “password123” as your password. It is your duty to take appropriate measures to protect your hardware and data from viruses, malicious software, and any inappropriate content. Additionally, you are required to create backups and maintain duplicate copies of any information stored or transferred through the Fuelbtc Services. Failure to comply with this clause may result in claims or losses for which we cannot be held responsible.

2.3. Security Measures

Maintaining the highest level of security for your Access IDs is crucial. Both you and any Permitted Users must prioritize this aspect. It is your responsibility to implement the necessary security measures (or ensure that your Permitted Users do so) to safeguard your Fuelbtc Account and keep your Access ID secure.

To ensure the utmost security and protection of your Fuelbtc Account, we kindly request that you adhere to the following guidelines:

• It is imperative that you strictly abide by all of our mechanisms and procedures.
• Create a robust password and maintain the security and control of your Access IDs.
• Keep our Email Account and telephone number up to date so that you can receive any important notices or alerts that we may send you.
• Never allow remote access or share your computer and/or computer screen with anyone while logged on to your Fuelbtc Account.
• Please remember that, under no circumstances, will we ever ask you to share your passwords or 2-factor authentication codes.
• Always emember to log out from the Sites or the Platform at the end of each visit. It is of utmost importance that you keep your Email Account and Access IDs secure against any potential attacks or unauthorized access. By adhering to these guidelines, you are ensuring the safety and integrity of your Fuelbtc Account.
• Regularly change your fuelbtc and email password if you suspect unusual login activity, logout of all devices.

2.4 User Obligations and Responsibilities

2.4.1 Company will provide each registered User with a unique set of User Credentials to access their Account on the Site and Platform. It is the responsibility of each User to promptly acknowledge receipt of these User Credentials to the Company.

2.4.2 You acknowledge and agree that the information and services offered by the Platform are intended only for individuals or entities who meet our terms and conditions. They may not be used by or for the benefit of any unqualified individual or entity.

2.4.3 Each User must:

(a) Maintain strict confidentiality of their User Credentials and refrain from sharing them with anyone else, including for the purpose of initiating or executing payment transactions involving the Account. User Credentials should not be disclosed in a recognizable manner to third parties on any device, such as writing them down or recording them without disguising them.

(b) Take reasonable measures to secure all records related to their User Credentials, keeping them in a secure physical location known only to the User and unlikely to be accessed by a third party.

(c) Follow all security instructions provided by the Company and take necessary steps to protect the security of the User Credentials, Site, and Platform. This includes adhering to the security measures outlined in our Privacy Policy.

(d) Immediately notify the Company through the designated channels in the event of:

• Loss of User Credentials
• Disclosure or compromise of User Credentials to third parties.
• Reasonable suspicion of unauthorized use of User Credentials.

(e) To enhance the security of your account, it is crucial to create robust passwords and PINs. For passwords, it is recommended to use a combination of letters, numbers, and special characters, while avoiding easily accessible personal information. Similarly, for PINs, it is advisable to avoid consecutive numbers or basing them on easily accessible personal details such as contract ID, birth date, telephone number, or identification number.

When the Platform is accessed by correctly entering User Credentials or through the App, it will be considered that the respective User has gained access to the Platform. It is your responsibility to ensure that only authorized individuals, acting on your behalf, access the Platform. The Company is not obligated to investigate or verify the identity of any User or Authorized Individual. Consequently, the Company cannot be held liable for any losses incurred due to unauthorized use of your User Credentials or Account, whether or not you were aware of such usage. Upon receiving notification as outlined in Section 11.3(d), the Company will promptly disable the relevant User Credentials and block access to the Platform or the Site.

We prioritize the security of your account and strongly advise following these guidelines to protect your information.

2.4.4 Each user is responsible for ensuring the security of all their devices or systems used to access the Platform, such as the App. This includes the installation and regular updating of browsers, security patches, antivirus, anti-malware, and other relevant software on their devices or systems. Additionally, users must adhere to all instructions, procedures, and directions provided by the Company regarding the Platform, the Site, and User Credentials. This includes, but is not limited to, complying with risk management measures and other guidelines communicated on the Platform login page. It is crucial for users to prioritize the protection of their devices and follow the necessary security protocols to ensure a safe and seamless experience on the Platform

3. Fees

3.1 There’s no charge to download the App and register as a User, but we may charge for certain in-app purchases and other features as specified from time to time.

3.2 In order to access the Platform and the Services, you are required to pay a fee for each settled transaction initiated by you (referred to as a “Transaction Fee”). The current Transaction Fee can be found on the Site after logging into your Account. We reserve the right to change, modify, or increase the Transaction Fee at any time. Any such changes will be effective upon posting on the Site. If you do not agree to the posted changes, you should discontinue using the Account as provided herein. By continuing to use the Account after the modified Transaction Fee is posted on the Site, you accept all such changes or revisions.

3.3 Transaction Fees are paid by the trading parties involved in each transaction. Both parties will be charged a fee in USDT/USDC or other approved currencies. You are responsible for any fees imposed by third parties when transferring Digital Assets into your Account on the Platform. The Platform also charges a fee for transferring Digital Assets from your Account.

3.4 If you believe that you have been incorrectly charged a Transaction Fee, you must immediately notify the Platform of the error, providing any additional information regarding the transaction. If you do not raise any questions or objections within thirty (30) days after the alleged erroneous Transaction Fee first appears on any Account statement, the fee will be deemed acceptable by you for all purposes.

3.5 You may incur transaction and other fees in connection with your Third-Party Account. These fees are specified in the Third-Party Services Provider Terms. We assume no responsibility or liability for any fees imposed by third parties.

4. Platform sage and Services

4.1. Platform Access and Availability

4.2 Service Offerings and Limitations

We offer some pretty nifty services, when your account is verified,  however there may be limitations. This limitation includes suspension or termination of the whole account. We’ll spell them out clearly, so you know what to expect. Transparency is the name of the game here.

4.3 Account Suspension or Termination

4.3.1 Access to the Platform may be suspended or terminated in whole or in part at any time either by the User or by us in accordance with the Terms. In addition, we reserve the right at our sole discretion to suspend or terminate immediately and without notice any User’s access to or use of the Site and the Platform if they violate any provision of these Terms or otherwise according to stated above. Your access to the Platform will be automatically terminated upon termination of your Account.

We may, at any time and at our sole discretion, limit, suspend or terminate, or issue a warning to you regarding, the Platform or the Account, including terminating the Account (or certain functionalities thereof such as uploading, receiving, sending and/or withdrawing Digital Assets), inter alia, if:

(a) we believe it is necessary or desirable to protect the security of the Account;

(b) if any transactions are made which we in our sole discretion deems to be (a) made in breach of this Agreement or in breach of the security requirements of the Account; or (b) suspicious, unauthorized or fraudulent, including without limitation in relation to money laundering, terrorism financing, fraud or other illegal activities;

(c) if we become aware or suspect that any Digital Assets or funds held in your Account may be associated with criminal proceeds or otherwise are not lawfully possessed by you;

(d) upon the insolvency, liquidation, winding up, bankruptcy, administration, receivership or dissolution of User, or where we reasonably consider that there is a threat of the same in relation to you;

(e) We are unable to verify or authenticate any information you provided;

(f) We believe, in our sole and absolute discretion, that your actions may cause legal liability for you, the Platform or other Users of the Platform;

(g) we decide to cease operations or to otherwise discontinue any services or options provided by the Platform, or parts thereof;

(h) There is a change in your circumstances (including a deterioration in or change to your financial position) which we consider, in our sole discretion, material to the continuation of the Account;

(i) We are directed as such by any Governmental Authority;

(j) We are otherwise required to do so by applicable law;

(k) There is a disruptive market event that triggers a trade halt; or (l)we otherwise decide in our sole discretion that termination or suspension of the Account, the Platform or the Terms is necessary.

4.3.3. We have no obligation to inform you of the ground or basis for suspending, terminating or freezing your Account or any digital assets in your Account or other actions we take regarding the Site, the Account, or the Platform.

4.3.4. Neither the Company, the Platform nor any third party acting on their behalf shall be liable to you for any suspension, limitation or termination of your Account or your access to any part of the Platform in accordance with this Agreement.

4.3.5. You shall not attempt to regain access to the Platform if your access is terminated by us, whether using the same or different username, without our prior written consent.

4.3.6. If there is any ongoing transaction on the Account that is subject to the termination procedures, the Company shall have the right to notify your counterparty of the proposed termination.

4.3.7. The Company maintains full custody of the assets, funds and user data/information which may be turned over to Governmental Authorities in the event of your Account’s suspension or termination arising from fraud investigations, investigations of violation of law or violation of these Terms. We will not be liable to you, your Authorized Individuals and/or any third party for loss or damage suffered due to delay, transmission errors, technical faults or defects, breakdowns and illegal intrusion or intervention in the information provided and services offered, or any failures or delays in completing any orders or transactions using any Account. Similarly, we will not be liable for any loss or damage suffered due to delays, technical faults or interruptions in the availability of the Site, the Platform, or any Account (including maintenance work required by our systems).
